Terms of Service
Effective April 16, 2026
These Terms of Service (“Terms”) govern your access to and use of MyHealDesk (“MyHealDesk,” “we,” “us,” or “our”), a software-as-a-service platform for physiotherapy practice management (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a binding contract. You represent that the information you provide at signup is accurate and that you are authorized to register on behalf of the clinic or organization you represent. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
2. The Service
MyHealDesk provides tools for managing appointments, patient records, therapy sessions, training programs, invoicing, and related operational workflows. Features may be added, changed, or removed over time.
MyHealDesk is not a medical device, is not a substitute for clinical judgment, and does not provide medical advice. You remain solely responsible for the clinical decisions you make and for the care you provide to your patients.
3. Your data and patient data
You retain all ownership rights in the data you submit to the Service, including clinic configuration, appointments, and patient records (“Customer Data”). You grant MyHealDesk a limited licence to host, process, and display Customer Data solely as needed to provide the Service.
With respect to any personal data of your patients, you are the “Data Controller” and MyHealDesk is the “Data Processor,” as those terms are used in applicable privacy law (including GDPR where relevant). You represent that you have a lawful basis to collect and share patient data with us, and that you will comply with all laws applicable to your collection, storage, and use of that data, including any local healthcare data protection rules.
4. Acceptable use
You agree not to:
- Use the Service in violation of any law or regulation.
- Upload malicious code or attempt to interfere with the Service’s integrity.
- Attempt to access another clinic’s data without authorization.
- Reverse engineer the Service except to the extent permitted by law.
- Resell or sublicense the Service without our written consent.
- Use the Service to send spam, harass, or impersonate others.
5. Third-party integrations
The Service may let you connect to third-party services (e.g. Google Calendar, Resend for email). Your use of those services is governed by their own terms. MyHealDesk is not responsible for outages, data loss, or policy changes in third-party services.
6. Fees and billing
Paid plans (if applicable) are billed in advance on a recurring basis as described on our pricing page. You authorize us (or our payment processor) to charge your payment method for all applicable fees. Fees are non-refundable except where required by law. We will give at least 30 days’ notice before increasing fees.
7. Confidentiality
Each party will protect the other’s Confidential Information with the same care it uses for its own, and in any case with reasonable care. “Confidential Information” includes Customer Data and any non-public information disclosed in connection with the Service.
8. Intellectual property
MyHealDesk, including the software, design, and branding, is the property of MyHealDesk and its licensors. Except as expressly granted in these Terms, no rights are transferred to you. You may provide feedback, and if you do, we may use it without restriction or obligation.
9. Termination
You may cancel your account at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms, and we will make a reasonable effort to notify you first. Upon termination, your right to use the Service ends immediately. You may export your data within 30 days after termination, after which we will delete it (subject to records we are required to retain by law).
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, MyHealDesk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with the Service. Our total aggregate liability for any claims relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) one hundred U.S. dollars (USD 100).
12. Indemnification
You agree to indemnify and hold MyHealDesk harmless from any claim, loss, or damage (including reasonable legal fees) arising from (a) your violation of these Terms, (b) your violation of any law or third-party right, or (c) your use of the Service in a manner not authorized by these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Delaware, except where mandatory local law grants you the right to bring a claim in your place of residence.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to account holders at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you may cancel your account.
